Protecting Charity Assets & Ensuring Statutory Compliance
For many disposals of charity land or property, Section 119 of the Charities Act 2011, as amended, requires trustees to obtain and consider a designated adviser’s written report before committing to the transaction. Requirements depend on the disposal and any applicable exemptions. Our local RICS Registered Valuers provide Designated Adviser’s Reports to support trustees in securing the best terms reasonably obtainable.
When Is a Report Legally Required?
A designated adviser’s report is generally required for the following transactions, subject to the statutory exemptions and the particular type of disposal:
Freehold Sales: Disposing of land or buildings permanently.
Leasehold Disposals: Requirements vary with the location, use, lease term and any premium. Commercial leases over seven years and leases with a premium generally require a designated adviser’s report; other leases may require competent advice instead.
Property Rights: Granting third-party easements, wayleaves, or covenants.
